I do not have a National Insurance Number, how do I get one?

What is my employment status when working through SmartWork?
You are employed by SmartWork as a member of our flexible mobile workforce. This means you are entitled to full statutory employee benefits.

Do I get paid holiday?
Yes. We can accrue your holiday pay so when you take holiday you get paid. You will be paid 7 hours per day at the rate of the national minimum wage. You are entitled to 28 days holiday including bank holidays per annum.

What does search week mean?
Search week is a week that occurs at the end of a contract. If you do not have a new contract to start immediately we will pay you a week at the national minimum wage while you search for a new role.

Can I be caught by the IR35 legislation?
No. You will be working as an employee of SmartWork and will be taxed at full PAYE tax and national insurance. Therefore you will be working within the IR35 legislation and paying all your tax liabilities.

Is SmartWork caught by the MSC legislation?
As SmartWork deducts full PAYE tax and National Insurance on all your earnings we are not caught by the MSC legislation. There is no risk of debt transfer to either you or your Agency.

Do I have to provide receipts for all my expenses? Or do you have a dispensation?
Yes, you must provide copies of receipts for all expenses other than mileage and overnight subsistence. We do have a dispensation, but we are still required by law to obtain copies of your receipts to support your expense claims.

What do I do when I secure a new contract?
When your Agency asks you how you wish to be paid please advise them that you are working through a Limited Company - SmartWork.com Limited, company number: 4207299 and request they contact either your business manager or contracts@smartwork.com. Alternatively they can call 0800 4346446.

What business insurance do you provide?
As an employee of SmartWork you are covered by our business insurances provided by Intersure Insurance brokers.

Public liability insurance covers damages and legal costs resulting from injury, death or damage to property caused to members of the public by any of your business activities.

Professional indemnity insurance covers businesses giving advice or providing services in a professional capacity. It protects against legal liability for losses suffered by customers as a result of negligent advice.

Employers' liability insurance enables businesses to meet the costs of damages and legal fees for employees who are injured or made ill at work through the fault of the employer.

What is the difference between CHAPS and BACS payment?
Money paid via CHAPS payment should reach your bank account the same day. BACS payments generally take 2 - 3 working days to reach your account. We will make all of our payments to you by CHAPs.

How often does the company make payments?
We have a daily pay run. As long as we receive your funds before midday, we will pay the funds through to you on the same day and the funds will reach your account by the end of the working day.

Does the scheme offer any additional benefits?
SmartWork offer our employee’s many benefits when working through us. Please see our SmartBenefits page for further details on these.

What is the fee structure? Do you charge a fixed weekly/monthly fee, or do you charge a percentage of my gross invoice value? Do you charge if I have time off?
We charge you a fixed fee depending on the frequency of your timesheet submission. Our monthly fee is £60 per month and weekly is £22.95 per week. After tax this is as little as £15.84 for lower earners and as £11.25 for higher earners per week Or £41.40 for lower earners and £29.40 for higher earners when paying monthly.

These are not charged to you when you do not work.

What is the payment frequency? If you submit your timesheet to your umbrella on schedule, how long before they guarantee payment will hit your bank account?
This depends on the paycycle of your agency/client. We run daily pay runs and so will make the payment through to you by CHAPs on the day we receive it.

Are there any hidden costs, such as joining or leaving fees?
There are no joining or leaving fees and you are not tied into our services for any length of time. You will only need to pay our fee when you are invoicing through us.

Do you offer a guaranteed level of customer service?
SmartWork operates within its Service Level Agreement (SLA). If we do not meet our SLA’s, we will waive the admin fee for one week or deduct the cost of one week from your monthly fee!

Do you have an online portal?
SmartWork has a user-friendly, common sense system where you can input your timesheet details, check on the progress of expenses and salary payments and view your payslip and work record. Login details to the SmartPortal will be given to you upon signing up.

How long will it take to set me up to work through SmartWork?
Once we have received a copy of your contract from your agency/client, we will be able to duplicate this onto our own contract and begin invoicing for you.

What do Benchmarking contracts mean?
Benchmarking contracts are a form of contract provided under the Agency Worker Regulations 2010. Under a Benchmarking contract you receive the benefit of the same pay rate as the comparator permanent employee at the client for whom you are carrying out an assignment after 12 weeks.

What do Swedish Derogation contracts mean?
Swedish Derogation contracts are a form of contract provided under the Agency Worker Regulations 2010. Under a Swedish Derogation contract you receive the benefit of 4 weeks’ pay at 50% of your assignment rate at the end of an assignment or during your notice period. In return your assignment rate is not matched against a client permanent employee's rate after 12 weeks.

What is the AWR and what does it entitle me to?
The AWR is the Agency Worker Regulations 2010 and it entitles you to equal treatment in respect of “basic working and employment conditions” with a comparator permanent employee at the client for whom you are carrying out an assignment. Some equal treatment is from Day 1 - access to facilities, information about the client's vacancies and some after 12 weeks, pay (unless you are on a Swedish Derogation contract), duration of working time; length of night work, rest periods, rest breaks, annual leave and paid time off for ante natal appointments.
